Intoxicating products bannedIntoxicating hemp already banned. Nov 1 adds Consumer Protection Act exposure. A licensed market opens in 2027. Since Jul 1, 2023 Virginia has used a total-THC test (0.3%) with a 2 mg total THC per package cap. On Aug 15, 2026 the 25:1 CBD ratio exception ended and hemp oversight moved to the Cannabis Control Authority. From Nov 1, 2026, selling a product over 0.3% total THC or over 2 mg total THC becomes a prohibited practice under the Virginia Consumer Protection Act. The Attorney General can investigate and sue. The other side of the ledger: the Cannabis Control Authority begins accepting retail license applications Feb 1, 2027, for up to 350 licenses, with legal adult-use sales from Jul 1, 2027.
