Intoxicating products bannedTexas DSHS states that delta-8 THC is controlled and only naturally occurring trace amounts are exempt; the schedule took effect July 31, 2026. Separately, in-state processing or manufacturing of consumable hemp products for smoking is prohibited, while DSHS says a lower-court injunction continues to allow their distribution and retail sale. Consumable hemp products remain subject to the 0.3% delta-9-THC dry-weight limit and 21+ sales rules.
